The agreement between you and Branemind for using our website, products, and services.
1. Acceptance
By using the Branemind website or any of our products and services, you agree to these terms. If you don't agree, please don't use them.
2. Use of services
- You agree to use our services lawfully and in line with any documentation we provide.
- You agree not to interfere with the security or integrity of our services, or to attempt unauthorized access.
- You are responsible for maintaining the confidentiality of any credentials we issue to you.
3. Intellectual property
Branemind retains all rights, title, and interest in and to our products, services, branding, and any underlying technology, except where we expressly grant rights in writing.
You retain ownership of any data or content you provide to us. You grant us a limited license to process it solely to deliver the services you've requested.
4. Confidentiality
Each party will protect the other's confidential information using reasonable care and will use it only as needed to perform under these terms.
5. Fees
Where applicable, fees are described in a separate order form, statement of work, or product page. Unless otherwise agreed, fees are non-refundable.
6. Warranty disclaimer
Our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of liability
To the maximum extent permitted by law, Branemind shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our aggregate liability under these terms is limited to the fees you paid us in the 12 months preceding the claim.
8. Termination
Either party may terminate an engagement as set out in the relevant order form or statement of work. We may suspend or terminate access to the website or services if you breach these terms.
9. Governing law
These terms are governed by the laws of India. The courts at Mumbai have exclusive jurisdiction over any disputes, subject to the dispute-resolution mechanism agreed in any signed engagement letter.
10. Changes
We may update these terms from time to time. We'll post the updated terms here and, where appropriate, notify you. Your continued use of our services means you accept the updated terms.
