The common failure is architectural rather than legal. Consent state and contact policy sit in a dashboard that someone reviews weekly, while the sending service reads from a list. The policy is real and the system does not enforce it.
Putting the checks in the send path costs very little and changes the compliance position entirely, because a breach becomes a blocked message rather than a discovered incident.

- Channel permitted for this borrower and this stage of delinquency.
- Contact frequency within cap, counted across channels rather than per channel.
- Local time within permitted contact hours for the recipient.

Measure the guardrail, not only the recovery
Contact rate and recovery rate on their own will make an aggressive configuration look excellent. Dispute rate, complaint rate, opt-out rate and block rate are the counterweight, and they belong on the same dashboard as the recovery figures rather than in a separate compliance pack.
